These Terms of Service ("Terms") govern your access to and use of the RETM Solutions platform and services operated by Southern Referral Associates Inc., doing business as RETM Solutions ("RETM Solutions," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
RETM Solutions provides a software-as-a-service (SaaS) platform for real estate transaction management, including transaction workflow management, MLS/IDX listing integration, client portal functionality, mobile applications for iOS and Android, lobby TV display management, AI-powered property search, social media automation tools, and related features for real estate brokerages and agents.
You must be at least 18 years old and a licensed real estate professional or authorized representative of a real estate brokerage to register for an account. By creating an account, you represent that all information you provide is accurate and that you have the authority to bind any entity on whose behalf you are registering.
You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations, including Florida real estate licensing laws, MLS rules and regulations, the Real Estate Settlement Procedures Act (RESPA), and applicable Fair Housing laws. You may not:
The platform integrates with Stellar MLS and other Multiple Listing Services to provide IDX listing data. Your use of IDX data is subject to the rules and policies of the applicable MLS, including requirements to display listing attribution information (ListOfficeName) on all listings. You are solely responsible for compliance with MLS membership rules and IDX policies.
If you use the platform to send SMS or other electronic communications to clients, co-operating agents, or other parties, you are responsible for obtaining all necessary consents required by the Telephone Consumer Protection Act (TCPA) and applicable state laws before sending such communications. RETM Solutions provides tools for managing communications but does not guarantee compliance with applicable communications laws on your behalf.
If you use the platform's features to refer clients to affiliated lenders, title companies, or other settlement service providers, you are responsible for complying with RESPA Section 8 disclosure requirements. The platform provides AfBA disclosure tools to assist with compliance, but you remain solely responsible for ensuring proper disclosures are made.
RETM Solutions and its licensors own all right, title, and interest in and to the Services, including all intellectual property rights. These Terms do not grant you any right to use the RETM Solutions name, logo, or trademarks without our prior written consent.
Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you upload to the platform and grant us a limited license to process that data to provide the Services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RETM SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Either party may terminate these Terms at any time. Upon termination, your right to use the Services will immediately cease. We may suspend or terminate your access for violation of these Terms or any applicable MLS rules.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Citrus County, Florida.
We may modify these Terms at any time. We will notify registered users of material changes. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
