Terms of Service

These Terms of Service govern RETM Solutions, operated by Southern Referral Associates Inc. d/b/a RETM Solutions, and the RETM websites, dashboards, portals, mobile apps, Roku and TV display apps, screensaver apps, APIs, IDX tools, marketing tools, communication tools, and related services we provide. Some consumer-facing real-estate services, including Real Estate Genie, Home Buying Genie, Home Listing Genie, and brokerage services, may be provided by Southern Realty Associates or another participating brokerage while using RETM technology.

Using RETM

RETM is a software platform for real-estate brokerages and their authorized users, including brokers, agents, staff, clients, lenders, vendors, and invited consumers. By using RETM, you agree to use the services only for lawful business or authorized client purposes, follow applicable real-estate, privacy, advertising, MLS, fair housing, record-retention, and consumer-protection rules, provide accurate information, and protect account access.

Brokerage Responsibility

Brokerages remain responsible for their agents, licenses, transaction supervision, consumer disclosures, advertising approvals, document retention, and compliance decisions. RETM provides tools and records; it does not replace broker judgment or legal advice.

Accounts, Authorization, and Pairing

You may use RETM only if you are authorized to do so by RETM, your brokerage, your agent, or the client or business account you represent. You are responsible for keeping login credentials, verification codes, device pairing codes, and display access secure. Pairing a Roku, TV display, screensaver, mobile app, or client device means you are authorizing that device to show or control the information available to that account or display.

Roku, Screensaver, and TV Display Apps

RETM Display, RETM Screensaver, RETM Client, and other TV apps are intended to show brokerage-approved or user-authorized information such as listings, photos, agent information, lender content, evergreen content, social prompts, client favorites, rejected listings, tour lists, saved searches, and related display workflows. You may not pair or control a display unless you are authorized to do so, and you may not use the display apps to scrape, redistribute, misrepresent, or publicly present information in violation of MLS, brokerage, client, or platform rules.

MLS, IDX, Listing, and Real-Estate Information

Listing information, photos, pricing, status, property details, listing brokerage attribution, QR codes, and related real-estate content may come from MLS, IDX, brokerage, agent, seller, public-record, or third-party sources. It may be delayed, changed, corrected, sold, withdrawn, incomplete, or unavailable. RETM does not guarantee the accuracy, completeness, availability, or suitability of listing information. Brokerage and MLS attribution, required disclaimers, and permitted field limits must not be removed or bypassed.

Client Portals, Favorites, Tours, Searches, and Transactions

Client-facing features are provided for authorized client, agent, and brokerage collaboration. Favorites, rejected listings, tour lists, saved searches, pending-home photos, transaction updates, documents, offers, communications, and related workflows may be visible to the people authorized for that client relationship or transaction. You are responsible for confirming important facts directly with your agent, brokerage, lender, inspector, title company, attorney, or other professional advisor.

Messaging, Calls, and Email

RETM may provide account, login, verification, transaction, listing, appointment, customer-care, lead-assignment, and marketing communications by email, phone call, SMS, MMS, push notification, or in-app message. Message and data rates may apply. Message frequency varies. Text STOP to opt out of texts, HELP for help, use unsubscribe links where available, or ask to be removed from calls at any time. Consent to calls or messages is not a condition of purchasing real-estate services.

Calls may be placed manually or with an automatic telephone dialing system and may include prerecorded or artificial voice messages where permitted. Text opt-out requests may include STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. Carriers are not liable for delayed or undelivered messages, and delivery is not guaranteed.

Payments, Documents, E-Signature, and Third-Party Services

Certain features may involve payment processors, identity verification, electronic signatures, cloud storage, MLS providers, social platforms, email or messaging providers, QR-code providers, analytics providers, or other third-party services. Your use of those features may also be subject to the third party's own terms and privacy policy.

Prohibited Uses

You may not misuse RETM, interfere with the service, attempt unauthorized access, copy or scrape data, remove required attribution, violate MLS or brokerage rules, upload unlawful or infringing content, use the platform for discriminatory advertising or conduct, impersonate another person, or use the service in a way that harms RETM, a brokerage, an agent, a client, a consumer, or a third party.

Platform Availability

We work to keep the platform reliable and secure, but no online service is guaranteed to be uninterrupted. Planned or emergency maintenance may occur as needed. We may modify, suspend, or discontinue features, and we may suspend or terminate access when needed for security, nonpayment, compliance, legal, MLS, brokerage, or misuse reasons.

No Professional Advice or Brokerage Relationship by Software Use

RETM provides software tools. Viewing a listing, scanning a QR code, using a display, receiving an automated estimate, or using a portal does not by itself create a brokerage, agency, lender, attorney-client, tax, or advisory relationship. Real-estate brokerage services are provided only by a licensed brokerage and its authorized representatives under applicable agreements and disclosures.

Disclaimers and Limitation of Liability

RETM is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties that the service will be uninterrupted, error-free, or meet every need. To the fullest extent permitted by law, RETM and its owners, employees, contractors, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or business interruption.

Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information across RETM services. By using RETM, you also agree to the Privacy Policy.

Changes

We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date. Continued use of RETM after changes are posted means you accept the updated Terms.
